Motion for New Trial

DEFENDANT, by and through the undersigned attorney and pursuant to Rules 3.580, 3.590, and 3.600, Washington DC Rules of Criminal Procedure, respectfully requests that this Honorable Court grant a new trial in the above-styled cause. As grounds for this Motion, Defendant states as follows:

  1. This Court committed prejudicial error in denying Defendant’s Motion for Judgment of Acquittal made at the close of the State’s case.
  2. This Court committed prejudicial error in denying Defendant’s Motion for Judgment of Acquittal at the close of all the evidence.
  3. The verdict is contrary to the weight of the evidence.
  4. The Court erred in its decision, over objection by the defense, to permit closing argument regarding what would have allegedly happened if Defendant had found the victim in her home.

      WHEREFORE, Defendant respectfully requests that this Court grant a new trial for the reasons outlined above.
